Fitness to exercise

The purpose of an exercise programme is to help you to achieve health and fitness goals. Your programme will be based upon your present activity/exercise levels and the goals that you wish to achieve. You will experience some feelings of exertion during each activity session and will become hot and uncomfortable at times. Your breathing and heart rate will increase as a result of these activities as would be expected from physical exercise of this type.

As your fitness improves, you will participate in more vigorous levels of activity, if this is part of your goal, but these should remain within your capabilities. All activities will be explained and demonstrated to you but please feel free to ask questions about anything you wish. Any exercise programme carries with it an element of risk.

Your sessions are designed to minimise the risks whilst providing an effective exercise/activity programme. Please inform your trainer if, for any reason (such as illness or injury which might be aggravated by exercise, or eating certain foods), you should not participate in an activity.

During your sessions with your trainer present you will be closely supervised. During your sessions where your trainer is not present you will be responsible for your own safety. If, at any time, you feel undue pain or excessive discomfort stop the activity and inform your trainer of your symptoms.

You should seek medical advice if your health status changes in any way to ensure you are always fit to continue exercising. If any of the questions answered in your PARQ form change, you agree share this information with BEN MARSHALL FITNESS before your next appointment so your programme can be reviewed.

Health and Safety

You should arrive at your appointments in a fit state to exercise. If you are found to be under the influence of drugs or alcohol, BEN MARSHALL FITNESS reserves the right to terminate your appointment without refund or transfer of services to another date.

You agree to wear suitable clothing that will allow you to exercise comfortably and safely. Trainers are heavily advised - please do not wear anything that could compromise your safety (no sandals or open toe shoes) or get caught in any machinery.

Indemnity. The Client agrees to indemnify and hold harmless BEN MARSHALL FITNESS for any injuries, illnesses, and the like experienced as the result of the client’s training sessions. 

Payment Terms

Payment for all services provided by BEN MARSHALL FITNESS is to be made before any services commencing. Any appointments made are considered provisional until such time as payment is made and therefore subject to change or cancellation. Payment may be made directly via the BEN MARSHALL FITNESS website (processed via Squarespace and Stripe) or via BACS after receiving an invoice from BEN MARSHALL FITNESS.

Cancellation Policy

Appointments may be cancelled or rescheduled up to 48 hours prior. No refunds will be given if the appointment is cancelled or rescheduled outside this cancellation window. This also applies to package bookings whereby your appointment will be taken from your remaining allocation if you do not cancel within the agreed timeframe.

Appointment timings

Your appointment will start and finish promptly at the scheduled time. If you arrive late to the appointment, to ensure fairness to other customers, your appointment will still finish at the agreed time. No refunds or partial refunds will be given for lateness or missed appointments.

Data Processing and Protection

BEN MARSHALL FITNESS adheres to the principles of GDPR and the Data Protection Act 2018. All data is processed securely and financial information is processed and held by STRIPE. No payment data is stored or held by BEN MARSHALL FITNESS directly.

Any data such as name, telephone number and email addresses that are used for marketing will be done so in line with the relevant consent given by the client, which may be withdrawn at any time. BEN MARSHALL FITNESS uses a number of third-party platforms for marketing and promotion, including SQUARESPACE and MAILCHIMP. This data is stored securely by the aforementioned platforms and is not held directly by BEN MARSHALL FITNESS in another format.

Multimedia consent will be sought from clients at the time of booking in order to process certain data such as photographs, videos and audio recordings to be used for marketing and promotion purposes. This media may be used on channels such as websites, social media, email marketing, magazines, newspapers and other advertising. Clients are free to decline or withdraw their consent at anytime.

Group classes

Subscriptions to group classes will renew every four weeks until cancelled. Subscriptions entitle customers to a set number of classes per week, based on the package purchased. Unused classes will not roll out over into the following week and cannot be accrued.
